Terms of Service

These Terms of Service ("Terms") govern your access to and use of OMEN: Last Bastion (the "Game"), including the free campaign, competitive Tournaments and the Ranked Campaign, and all related features, websites and services (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Services. You are responsible for ensuring that your use of the Services — including any paid competition, purchase, or receipt of digital assets — is lawful where you live. The Services, or specific features of them, may not be available in every jurisdiction, and we may restrict access where required by law.

2. Your OMEN Account

Access to the Services requires an authenticated OMEN identity. You are responsible for maintaining the security of your OMEN account, wallet, and any credentials associated with it, and for all activity that occurs under your account. We authenticate you through OMEN; we never ask for your seed phrase, private key, or a direct wallet signature on our sign-in page. Notify us immediately of any unauthorized use.

3. License to Play

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and play the Game for your own non-commercial entertainment. You may not copy, modify, reverse engineer, decompile, scrape, resell, or create derivative works from the Services except as permitted by law.

4. Virtual Items, Currencies and Digital Assets

The Game features in-game resources and currencies (including but not limited to Energy, Salvage, Shards, OMEN), NFTs, and other digital collectibles. Except where expressly stated and technically supported, virtual items and in-game currencies are licensed to you for use within the Game, are not your property, and have no cash value. The availability, value, utility, transferability, and withdrawal status of any digital asset may vary by game mode, event, account eligibility, jurisdiction, and stage of development, and may be changed, limited, reset, or discontinued.

Nothing in the Services constitutes an offer of securities or financial products, and nothing is financial, investment, legal, or tax advice.

5. Competitions and Entry Fees

Certain Tournaments require an entry fee in OMEN; the Ranked Campaign is free to enter, with a fixed free daily run budget and no paid extra runs. Competitions are contests of skill: placement is determined by performance, and there are no chance-based payouts, raffles, or lotteries. Full entry costs, attempt limits, prize eligibility, and payout information are shown in-game before you enter and are governed by the Tournament Rules, which are incorporated into these Terms. Prize pools are not final until officially locked and settled. Winners are paid in the competition's own currency once an event settles.

6. Payments

All amounts are charged in the currency shown at the point of entry or purchase. You authorize us and our payment and blockchain partners to process the applicable amount. On-chain transactions are irreversible once confirmed. Entry fees and digital purchases are generally non-refundable except as described in our Refund Policy. You are responsible for any network, gas, or transaction fees and for any taxes arising from your use of the Services.

7. Fair Play and Prohibited Conduct

Ranked runs are server-authoritative: maps, seeds and scoring are issued by the server, and client-reported scores never settle money. You agree not to:

• use bots, automation, injected code, memory editing, or any tool that alters gameplay or scoring;
• exploit bugs, manipulate seeds or run tokens, or interfere with server validation;
• operate multiple or fraudulent accounts, collude, or engage in wash or coordinated play to influence standings or pools;
• reverse engineer or attempt to bypass anti-cheat, rate limits, or security controls; or
• use the Services for unlawful purposes, including fraud or money laundering.

We may suspend runs, void scores, withhold or claw back prizes, and suspend or terminate accounts for suspected violations, subject to anti-cheat review.

8. Intellectual Property

The Services, including all software, artwork, audio, text, and branding, are owned by us or our licensors and protected by intellectual property laws. Except for the limited license above and any rights expressly granted with a digital asset you acquire, no rights are transferred to you.

9. Beta and Changes to the Services

The Game is in active beta. Maps, enemies, turrets, perks, difficulty, balance, reward structures, pricing, competitive formats, and progression systems may change during development. Competitive lanes may be shown in preview mode or temporarily paused during staged rollout. During beta, balances, rewards, purchases, marketplace features, tournament results, and withdrawal functions may be adjusted, simulated, reset, limited, or temporarily unavailable unless expressly stated otherwise. We may modify, suspend, or discontinue any part of the Services at any time.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free. Playing the Game, purchasing upgrades, owning NFTs, entering tournaments, or achieving a ranking does not guarantee winnings, profit, prize recovery, or any financial return. Never spend more than you can afford to lose.

11. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, goodwill, or digital assets, arising out of or related to your use of the Services. To the maximum extent permitted by law, our aggregate liability for any claim will not exceed the greater of the amounts you paid to us for the Services in the 90 days before the claim, or USD 100.

12. Indemnification

You agree to indemnify and hold us and our affiliates harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

13. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties, or as required by law. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

14. Governing Law and Disputes

These Terms and any dispute arising from them are governed by the laws applicable to the operator of the Services, without regard to conflict-of-law rules. You agree to first attempt to resolve any dispute informally by contacting us. Where permitted, disputes not resolved informally will be handled on an individual basis, and you waive any right to participate in a class action.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
